On 24 March 2011, Frank G Anderson phoned the office of the prosecutor at Rachadaphisek to inquire re. status of a criminal defamation case filed against him by Pol Col Wattanasak Mungkijkarndee, a close associate of UK national Akbar Khan who had earlier filed an identical allegation with police.

Both allegations, filed in connection with a mild critique Anderson posted online re. lese majeste activities by Khan and Wattanasak, were investigated by cooperative police then filed with prosecutor's office recommending to proceed with court trial.

No one ever asked or recommended to Anderson that the offensive material be edited or removed and police investigations were opened initially with a Khan-provided Thai language translation - but no Ministry of foreign Affairs certification - of offensive material.

The prosecutor's office reportedly informed Anderson that he needed to arrange bail in June to present in Wattanasak's case, but provided no information regarding actual charges that would be filed against him. When he asked what the bail would be, he was told, "Ask the criminal court." The court informed Anderson bail would be 100,000 Baht.
