A 5-page leaked document written by Thammasat University's law lecturer Kittisak Prokati who is also a sub-committee member of the National Human Rights Commission (NHRC) raised questions over the quality and impartiality of the now deferred NHRC's report on the April-May 2010 deadly military crackdown on red shirt protesters.

The document, obtained by this writer and a few others on late Thursday night criticised the NHRC report of a number of crucial points.

These includes Kittisak stating that: "In general [the report] should begin by considering whether the state's actions affected human rights or not... and not to [first] analyse whether the actions of demonstrators violated human rights or not."

Kittisak also stated that regarding the state's use of force, "it must be considered whether the actions which affected human rights are justifiable or not".

"If there exists just reason for the state to limit rights, [the NHRC's report must also ask] whether the use of force was proportionate or not"

Kittisak pointed out that the NHRC's investigation did not question whether the declaration of the emergency decree by the government was "just or not".

In the end of the letter of review dated July 5, Kittisak proposed that the NHRC's report be "carefully reviewed before dissemination".

On Thursday, NHRC announced that the report's release was deferred with no new release date set despite having announced earlier that it will be released on Friday (Jul 8).
