วันนี้ (8 ต.ค. 52) เครือข่ายผู้ได้รับผลกระทบจากการไปทำงานต่างประเทศ ได้เดินทางไปยื่นหนังสือเรียกร้องขอความเป็นธรรมที่สถานทูตสวีเดนประจำประเทศไทย ส่วนรัฐมนตรีว่าการกระทรวงแรงงาน ระบุ บริษัทที่ส่งแรงงานไทยไปสวีเดน ยอมจ่ายค่าเสียหายตามจริง พร้อมตั้งคณะทำงานลงพื้นที่รับเรื่องแรงงานที่ประสบปัญหาในการไปทำงานที่ ประเทศสวีเดนเพิ่มเติม

Dear Sir,
The Network against Exploitation and Trafficking of Migrant Workers (NAT) would like to develop discussion and present suggestions concerning hoe to solve the problems and suffering of Thai migrant workers that are trafficked to pick berries in Sweden.
The Network against Exploitation and Trafficking of Migrant Workers (NAT) is an organization that was formed in early 2007 with the goal of ending ‘the blood-sucking trafficking businesses’ and implementation of sustainable development programmes to those trafficked to overseas, that has been, since early 1980, sucking the blood of more than three million people from the poorest regions of Thailand, notably rural workers and small farmers from the Northeast. For over two years NAT has been assisting workers who have been trafficked overseas and has now about 1000 members from 20 provinces, mostly from Isan and the North.
For a decade, the Ministry of Labour in Thailand has been stating that remittance from the approximately 350,000 Thai workers overseas amounts to 50-60,000 million Baht / annum. The point is that much of this money falls into the pockets of unscrupulous brokers and agencies, and never reaches the workers or their families.
Since early September this year NAT and the Thai Labour Campaign, which advises NAT, have been receiving complaints from several hundred Thai workers returning from Sweden. These are workers from poor farms, mostly from Isan, who were led to belief that during the two months preceding the harvest season in Thailand they could make 200,000 Baht picking berries in Sweden by paying 75-100,000 baht to one or other of 4 agencies that are authorised by the Ministry of Labour (MoL) in Thailand.
They walked over hills and mountains in Sweden and Finland but ended-up 100-200,000 Baht in debt (some went as husband-and-wife teams). Some of their stories have been reported in the media in both Sweden and Thailand. However, after their returning home in early September, negotiations between 400 of these workers, the Ministry of Labour and the four agencies have not been progressing.
On 27 September (2009) NAT and the Thai Labour Campaign arranged a conference at Chulalongkorn University to discuss the problem with the Human Rights Commissioners and other concerned organisations.
Many of these workers are now being pressured and chased by the brokers and banking institutions to pay their ‘debt’. Some have sold their land, some have received legal notice and many are being chased by telephone calls. Some choose not to return home because of the conflict in the family and embarrassment in facing their community.
On 29 September the workers submitted their appeal to the Prime Minister, with four areas of request for the Thai Government to:
- cancel the debt, or suspend payment and transfer the debt from agents/brokers to a government banking institution;
- provide a rehabilitation and income generating programme for the workers to be able to make-up for lost income;
- urgently process legal action against the brokers / agents, government officers and any other authorities involved in the trafficking of Thai workers to pick berries in Sweden;
- implement a transparent process to oversee the recruiting of Thai workers in order to prevent any agents / brokers / traffickers / businesses / corrupt bureaucrats from taking advantage of the system.
On May Day 2008 the NAT presented the Ministry of Labour with solutions to end the 34 years of the overseas labour trafficking business, namely for regulations governing compensation, prevention and for sustainable development programmes for the poor farmers that are targeted by traffickers.
We have also formulated proposals and demands for the implementation of Government to Government procedure to stop authorising agencies and brokerages which, according to our research, never charge according to the law.
Over 400 Thai workers returning from Sweden have applied to become members of NAT and have sought our assistance to help solve their problems. They have been camping at Government House since October 6, hoping to meet the Prime Minister. Now they are marching to the Swedish Embassy in Bangkok over the amount of kilometres they walk when picking berries in Sweden, to seek support from the Embassy and to open discussion with the Embassy on how to prevent such problems from happening again in the future.
We are very glad to hear that our representatives will be welcomed by the Ambassador. All of us wish to thank the Embassy of Sweden for understanding.
We would like to propose as follows;
1. The experience of the 400 Thai workers (members of NAT) who went to Sweden for 2 months work last October, to earn money for their families, has led to more suffering to their families and communities than anybody could have possibly imagined. A list of their names is attached to this letter.
2.. This type of short-term job creation should not be used for profit-making by the labour trafficking business.
We request that the Embassy of Sweden only grants permission to workers who apply through the procedure and channels that have been agreed by all parties, by the Embassy of Sweden, by NAT and by the Thai Ministry of Labour.
3. We wish to request that the Embassy of Sweden in Bangkok discuss with the Sweden Forest Berries Association (SBIF) the possibility of setting-up a fund to compensate / assist the victims on the list attached, that have launched their complaint to the Thai Government and appealed to the Embassy of Sweden. NAT is submitting the list of names to both the Thai Government and the Embassy of Sweden and will be most grateful for any assistance.
4. NAT wishes to see some pressure placed on the Thai Government to ensure that an independent committee is established to investigate the Thai trafficking agencies and associated Government agencies and officials, especially the Thailand Overseas Employment Administration (TOEA). We have heard stories about corruption in this department for years and suspect that this is part of the reason why the TOEA keeps handing the responsibility of recruiting workers to go overseas to the business sector, instead of appointing government, or non-profit organisations, or worker’s organisations to take responsibility.
5. We wish to request that the workers named on this petition, which are all members of NAT, be included in the first quota list of the Embassy of Sweden for the next years berry harvest season. NAT, without taking profit from our members, will process their applications and logistic arrangement in Thailand and will develop dialogue with LO in Sweden for further necessary support in the Sweden.

นายไพฑูรย์ แก้วทอง รัฐมนตรีว่าการกระทรวงแรงงาน กล่าวภายหลังการเรียกตัวแทน 4 บริษัทจัดส่งแรงงานไทยไปทำงานที่ประเทศสวีเดนมาเจรจาเพื่อหาข้อยุติในการ ช่วยเหลือแรงงานไทยจำนวน 202 คน ที่ได้รับความเดือดร้อนและมาร้องทุกข์กับกระทรวงแรงงาน จากปัญหาการจ้างงานที่ไม่เป็นไปตามสัญญาจ้าง ว่า ทั้ง 4 บริษัทได้ข้อสรุปร่วมกันในการช่วยเหลือแรงานที่ได้รับความเดือดร้อน โดยบริษัทยินยอมชดเชยค่าเสียหายซึ่งเป็นส่วนต่างหลังจากหักค่าใช้จ่ายใน ระหว่างที่ทำงานในประเทศสวีเดน เบื้องต้นบริษัทจะจ่ายเงินตามระยะเวลาที่แรงงานทำงานจริง โดยคิดจากเงินเดือน 8,000 บาท และเบี้ยเลี้ยงวันละ 500 บาท ตามสัญญาจ้าง เชื่อว่าข้อเสนอดังกล่าวแรงงานจะพอใจ และได้ข้อสรุปในวันนี้ ส่วนขั้นตอนต่อไปจะมีการตั้งคณะกรรมการเพื่อเจรจาไกล่เกลี่ย ประกอบด้วย ทีมที่ปรึกษาฝ่ายกฎหมายกระทรวงแรงงาน และจัดหางานจังหวัด เป็นคนกลางไกล่เกลี่ยระหว่างแรงงานกับบริษัท โดยจะเดินทางไปตามจังหวัดต่างๆ ที่มีแรงงานได้รับความเดือดร้อนในภาคตะวันออกเฉียงเหนือ อาทิ จังหวัดขอนแก่น อุดรธานี นครราชสีมา เพื่อรับเรื่องร้องเรียนเพิ่มเติม
รัฐมนตรีว่าการกระทรวงแรงงาน กล่าวอีกว่า แนวทางการช่วยเหลือแรงงานในครั้งนี้ หากยังไม่ได้ข้อยุติ และยืดเยื้อจนกลายเป็นปัญหาระดับประเทศ เกรงว่าจะส่งผลต่อการจัดส่งแรงงานไทยไปทำงานเก็บผลไม้ป่าที่สวีเดน เนื่องจากประเทศนี้ให้ความสำคัญต่อปัญหาการค้ามนุษย์ อาจทำให้คนไทยเสียโอกาสและรายได้จากการไปทำงานที่ประเทศสวีเดน
อนึ่ง ก่อนหน้านี้เมื่อวันที่ 5 ต.ค. ที่ผ่านมานายจีรศักดิ์ สุคนธชาติ อธิบดีกรมการจัดหางานคนใหม่ กล่าวถึงความคืบหน้าการสอบข้อเท็จจริง กรณีแรงงานไทยไปทำงานเก็บผลไม้ป่าที่ประเทศสวีเดนว่า คณะทำงานตรวจสอบข้อเท็จจริงจะประชุมนัดแรก ซึ่งหลังจากนี้จะมีแรงงานไทยเดินทางกลับจากประเทศสวีเดนรอบสุดท้ายจำนวน 94 คน รวมแรงงานทั้งหมดกว่า 5,900 คน ส่วนแรงงานไทยที่เดินทางกลับมาแล้ว และไม่ได้รับความเป็นธรรมจากค่าดำเนินการที่เรียกเก็บ ซึ่งจะต้องไม่เกินรายละ 75,000 บาท
สำหรับการแก้ไขปัญหาการจัดส่งแรงงานไทยภาพรวม กรมการจัดหางาน เตรียมเจรจากับประเทศตลาดแรงงานจัดส่งแรงงานไปทำงานเอง เพื่อป้องกันการถูกหลอกลวง โดยจะนำร่องในปีหน้าที่ประเทศแคนาดา พร้อมทั้งจะเจรจากับธนาคารพาณิชย์ ปล่อยเงินกู้ดอกเบี้ยต่ำให้กับแรงงาน เพื่อลดการกู้เงินนอกระบบ
นอกจากนี้จะแก้กฎหมาย บังคับให้แรงงานไทยที่เดินทางไปทำงานต่างประเทศ สมัครเป็นสมาชิกกองทุนไปทำงานต่างประเทศทุกคนในอัตราคนละ 500 บาท เพื่อเป็นเงินช่วยเหลือกรณีได้รับความเดือดร้อนระหว่างทำงาน ซึ่งขณะนี้มีเงินในกองทุนแล้ว 600 ล้านบาท
