"จดหมายตอบโต้” และ "ตอบจดหมายตอบโต้" - หลังสหภาพยุโรปกังวลต่อคำพิพากษา “สมยศ”

มีผู้เขียนจดหมายเปิดผนึกโต้อียู ระบุไทยเป็นชาติเอกราช-มีวัฒนธรรมของตนเอง สหภาพยุโรปอาจจะไม่เข้าใจ พร้อมแนะให้ไปดูแลโรฮิงญาถ้าสนใจเสรีภาพจริงๆ – ขณะที่มีผู้เขียนจดหมายตอบโต้ “จดหมายถึงอียู” เช่นกัน โดยแนะให้ใช้สติ รัชกาลที่ 5 ปฏิรูปประเทศให้อารยะ ขณะที่กฎหมายหมิ่นฯ ผ่านการแก้ไขมาหลายรอบ ยิ่งแก้ยิ่งสร้างปัญหาในการบังคับใช้ ระบุหากต้องการปกป้องสถาบันกษัตริย์ ต้องปกป้องเสรีภาพ

ตามเมื่อวันที่ 23 ม.ค. ที่ผ่านมา ภายหลังที่ศาลมีคำพิพากษาคดีนายสมยศ พฤกษาเกษมสุข ในข้อกล่าวหาตามประมวลกฎหมายอาญามาตรา 112 เป็นเวลา 10 ปี สำนักงานคณะผู้แทนสหภาพยุโรปประจำประเทศไทยและคณะเอกอัครราชทูตประเทศสมาชิกสหภาพยุโรปประจำประเทศไทย ได้ออกแถลงการณ์แสดงความกังวลต่อคำพิพากษาดังกล่าว และเรียกร้องให้ไทยกำหนดข้อจำกัดต่อสิทธิมนุษยชนขั้นพื้นฐานของประชาชนด้วยมาตรการที่เหมาะสม และสอดคล้องกับการรักษาไว้ซึ่งหลักสิทธิมนุษยชนสากลนั้น

ต่อมาเมื่อวันที่ 24 ม.ค. ผู้ใช้เฟซบุคนามว่า Robert Pattinzon ได้เขียนจดหมายเปิดผนึก จากคนไทยคนหนึ่งถึงสหภาพยุโรป โดยเขียนฉบับภาษาไทย และภาษาอังกฤษ เนื้อหาใกล้เคียงกัน และโพสต์รูปประกอบเป็นภาพประชาชนสวมเสื้อสีเหลืองร่วมในพระราชพิธีการเสด็จออกมหาสมาคม 5 ธันวาคม 2555 ฉากหลังเป็นรูปพระที่นั่งอนันตสมาคม พิมพ์ข้อความประกอบภาพว่า "Preserving our beloved Monarchy is the right of the Thai people - not the business of the EU." และ "สิทธิในการปกป้องสถาบันกษัตริย์ของไทย เป็นสิทธิของคนไทย ไม่ใช่สหภาพยุโรป" 

โดยมีรายละเอียดของจดหมายมีดังนี้

จดหมายฉบับที่หนึ่ง
จดหมายเปิดผนึก จากคนไทยคนหนึ่งถึงสหภาพยุโรป

ประเทศไทยเป็นประเทศเอกราช มีวัฒนธรรม
เป็นของตนเอง ซึ่งพวกคุณอาจจะไม่เข้าใจ

เรามีกฏหมายของเรา เรามีขนบประเพณีของเรา
เราให้ความเคารพพระเจ้าอยู่หัวของเรา

การให้ความเคารพต่อกษัตริย์ของเราไม่เหมือน
กับสิ่งที่พวกคุณทำต่อกษัตริย์ของพวกคุณเอง
และไม่ว่าคุณจะทำอะไร เราไม่เคยยุ่ง

คุณความดีที่กษัตริย์ของเรา ที่ทรงงานอย่างหนัก
เพื่อประชาชนของพระองค์นั้น ได้ประจักษ์ชัดและ
รับรู้กันไปทั่วประเทศ

ประชาชนล้วนแต่รักและเทิดทูนกษัตริย์พระองค์นี้
อย่างมาก ภาพประชาชนจำนวนมหาศาลที่ออกมา
ในวันที่ 5 เป็นเครื่องยืนยันได้อย่างดี

มีคนเพียงส่วนน้อย ที่พยายามจะล้มล้างสถาบัน ด้วย
วิธีการให้ข่าว ป้ายสีเรื่องราวต่างๆ นานา

ซึ่งการกระทำแบบนี้ไม่เป็นที่ยอมรับในสังคมไทย

คนไทยไม่มีนิสัยรุกรานใคร ไม่ต่อเรือไปยึดประเทศอื่น
ไม่ล่าอาณานิคม ไม่บังคับข่มเหงคนชาติอื่น

และเราไม่พยายามยัดเยียดความคิด เรื่องเสรีภาพ
ในแบบของตนเองให้กับใคร อย่าเอาคำจำกัดความแคบๆ
ในเรื่องเสรีภาพของคุณมาใช้กับเรา

เพราะคนในประเทศนี้ เราไม่ยอมรับเสรีภาพในการ
หมิ่นประมาทสถาบันอันเป็นที่รักของเรา

ถ้าสหภาพยุโรปสนใจเรื่องเสรีภาพจริงๆ ไม่ใช่แค่สร้าง
ภาพลวงโลกไปวันๆ ช่วยดูแลเสรีภาพในการมีชีวิตอยู่
ของชาวโรฮิงญาในพม่า จะดีกว่าไหม

Preserving our beloved Monarchy
is the right of the Thai people - not the business of the EU

From one Thai person to the EU:

Thailand is a free country, and has never been colonized by
any other nation. As such, more than any other country in
our region, we have our own distinct culture, much of which
has evolved around our beloved monarchy.

This may be difficult for Europeans to understand: It is our
long-held tradition to pay the utmost respect to our King,
with a type of respect that is unique to Asian cultures.

The way we admire our beloved King in our tradition, is very
different from how Europeans treat their own royalty.

Thai people would never presume to intervene in European
culture and tradition, no matter how foreign they may seem
to us. We ask you for the same respect.

Our beloved King has spent his life working hard for all of his
people, and everyone in the country knows very well the good
that he has done for the Thai people.

This is why Thai people love and respect this King to such a
degree. The pictures shown in the world media on the occasion
of His Majesty’s birthday, showing millions of people walking
out into the streets to celebrate, is the best evidence of the
peoples’ love and admiration for the King.

There is a very small group of people in Thailand that sling mud
on the monarchy in an attempt to bring it down, but this is a small,
though very vocal and militant, minority.

Most Thai people see this as unacceptable, and recognize that
it is only a handful of people that show disrespect in this culturally
unacceptable manner.

Here in Thailand, we do not invade other countries, or make bold
proclamations to condemn those traditions that other cultures
hold dear.

Please give us the same respect, and do not apply your narrow
definitions of freedom to force us to abandon our long-held
traditions and beloved monarchy.

This country will never accept the idea that it is an acceptable freedom
to show disrespect to the King in such outrageous ways.

If the EU is really interested in freedom—not just in creating an
impression to show the world—pay attention instead to the Rohingya
in Burma rather than this unwelcome intrusion into Thailand’s traditions.

ผมขออภัยที่เขียนจดหมายฉบับนี้มารบกวนเวลาของท่าน แต่หลังจากอ่านจดหมายฉบับหนึ่งที่เพื่อนร่วมชาติของผมเขียนขึ้นแล้ว พบว่ามีความคาดเคลื่อนอยู่มากไม่อยากให้ท่านและคนอื่นๆเข้าใจเราผิด

ผมอยากให้ท่านเข้าใจว่า ไม่ใช่คนไทยทุกคนจะมีสติปัญญาและความรู้อย่างที่ควรมี คนไทยหลายคนไม่รู้ว่ากลุ่มประเทศของท่านล้มลุกคลุกคลานผ่านประวัติศาสตร์มาอย่างไรบ้าง เขาไม่รู้ว่ากว่าจะมีสถาบันกษัตริย์ที่ยืนยาวสง่างามในประเทศได้นั้น ต้องมีเงื่อนไขใดเป็นองค์ประกอบ

ในแง่พระเกียรติยศ -- พวกเขาไม่เข้าใจว่าการลงโทษผู้คนอย่างรุนแรง การบิดเบือนบังคับใช้กฎหมายอย่างไม่เป็นธรรม การกล่าวอ้างสถาบันฯเพื่อหวังผลทางการเมืองของกลุ่มตน ไม่ว่าฝ่ายใดเป็นผู้กระทำ ย่อมไม่เป็นผลดีต่อชื่อเสียงของประเทศในสังคมโลก

พวกเขาไม่ยอมรับรู้ว่าสังคมโลกวิพากษ์วิจารณ์พวกเราอย่างไร เพราะหากพวกเขาใช้ “สติ”กันสักนิด ก็จะเข้าใจได้ไม่ยากว่าการทำเช่นนี้ ไม่เป็นผลดีต่อพระเกียรติยศของสถาบันฯ อันเป็นที่รักของชาวไทยเลยจริงๆ

ในแง่ระบบกฎหมาย -- เพื่อนร่วมชาติของผมไม่รู้จักประวัติศาสตร์ประเทศตัวเอง พวกเขาไม่รู้ว่าในหลวงรัชกาลที่ 5 ทรงปฏิรูปกฎหมายมานานแล้ว พระองค์พัฒนาระบบกฎหมายไทยให้มีความเป็นสากล เที่ยงธรรม เป็นอารยะ เพราะด้วยพระปรีชาสามารถมองการณ์ไกลทำให้ทรงทราบดีว่าความเป็นอารยะนั้นสำคัญต่อการอยู่ในสังคมโลก

เพื่อนร่วมชาติของผมด้อยความรู้ จึงไม่ทราบว่ากฎหมายหมิ่นพระบรมเดชานุภาพที่ใช้อยู่ในปัจจุบันนั้นผ่านการแก้ไขมาหลายครั้ง และทุกครั้งที่ถูกแก้ไข ก็สร้างปัญหาใหม่ขึ้น ขยายขอบเขตมากขึ้น และสร้างปัญหาในการบังคับใช้มากมาย

ในแง่เสรีภาพ -- เป็นเรื่องน่าเศร้าที่เพื่อนคนไทยของผมบางกลุ่มขาดความรู้ความเข้าใจ ไม่อาจแยกแยะได้ว่าเสรีภาพและการหมิ่นประมาทพระเกียรติยศของพระประมุขนั้นเป็นคนละเรื่องกันโดยสิ้นเชิง

เสรีภาพนั้นเป็นสิ่งจำเป็นพื้นฐานในการพัฒนาสังคม เป็นรากฐานสำคัญที่จะช่วยทำนุบำรุงพระเกียรติยศของสถาบันกษัตริย์ทั้งภายในและภายนอกประเทศ ในทางกลับกัน ผมไม่เคยได้ยินใครเรียกร้องหาเสรีภาพในการดูหมิ่นพระมหากษัตริย์ ความเคลื่อนไหวในเมืองไทย ณ ขณะนี้เป็นเพียงเพื่อปฏิรูประบบกฎหมายให้ดีขึ้น เป็นอารยะมากขึ้น ซึ่งหากเพื่อนคนไทยของผมจะติดตามข่าวสารด้วยสติปัญญาที่เปิดกว้างอยู่บ้าง ก็น่าจะเข้าใจได้ไม่ยาก

ผมเชื่อว่าท่านทราบดีว่าความเห็นของคนหนึ่งคน ไม่ใช่อาจเหมารวมเป็นความเห็นของคนทุกคนได้ ผมจึงไม่บังอาจไปอ้างว่าความเห็นของผมคือความเห็นของเพื่อนคนไทยทุกคน และด้วยเหตุนี้ ผมจึงเชื่อว่าการมีเสรีภาพในการแสดงออกอย่างสมบูรณ์เท่านั้น ที่จะเป็นกลไกช่วยสะท้อนภาพความคิดเห็นของผู้คนในสังคมไทยได้อย่างแท้จริง

สุดท้าย ผมขอขอบคุณในแถลงการณ์ของท่าน ขอบคุณน้ำใจไมตรีที่หยิบยื่นให้ผ่านคำตักเตือนถึงปัญหาที่ใหญ่และลึกซึ้งในสังคมของเรา ผมหวังว่าประเทศของผมจะทำในสิ่งเดียวกันแก่ท่านเมื่อมีโอกาส เพราะเราคนไทยเชื่อกันว่าการยื่นคำตำหนิติเตือนให้แก่กันในยามที่จำเป็นนั้น เป็นสิ่งมีค่าที่ผู้เป็นกัลยาณมิตรพึงกระทำต่อกันด้วยความจริงใจ

 

### An open letter from “another Thai citizen” ###
To the European Union Delegation to Thailand:

My fellow Thai citizen has recently wrote an open letter to you regarding his/her opinion on the Delegation's position on Somyot Pruksakasemsuk's case. The letter contains a number of inaccuracies that I wish to take this opportunity to clarify to you, as well as to the concerned observers of Thai politics.

I beg for your understanding that not all educated Thais are educated. Not all Thais have the knowledge and judgment that are worthy of being a global citizen in our time. Many Thais do not understand the tumultuous history that has shaped the European foundations of human rights, or how European sovereign states and their institutions are established and preserved. Many Thais do not know the social factors contributing to the rise and decline of the institution of monarchy.

*** With regard to the preservation of the Monarchy, many Thais do not understand that civilized legal system and legal principles are the basic requirements to defend their beloved Institution. The harsh punishment, manipulation of legal process, and the exploitation of the Monarchy for political agendas, regardless of the perpetrator, is damaging the Monarchy, as well as Thailand's reputation.

They do not acknowledge the fact that the world is criticizing them. Had they use their inner voice of reason and conscience, it would have been clear to them that they are not acting in the best interest of the Thai Monarchy.

*** With regard to the legal system, not only that many Thais do not know the history of the EU, they also do not know their own history. They do not know that the King Rama V of Siam (1853-1910), for his exceptionally keen vision of the changes in his era, has ordered a complete modernization of Siam's archaic legal system. The modernization guarantees an equal access to justice that follows the standard of the “civilized world”, in order for Thailand to become “civilized” - for the Thai nation to gain the respect and acceptance from outside world. This has led to cancellation of the extraterritoriality of Britain and other European powers in Thailand in 1938.

For their lack of knowledge of their own history, my fellow Thai citizens do not realize that the present form of the Thai lese majesty law has been amended for a number of times. Each of the amendment has allowed a successively wider range of interpretations on what constitutes a lese majesty, resulting in complications of enforcement and in infringement of the freedom of expression.

*** With regard to freedom and human rights, many of my fellow citizens regrettably do not understand the fundamental differences between freedom of expression and defamation of Monarchy.

Freedom is a fundamental requirement for society, an important foundation upon which we can protect and defend our Monarchy from both domestic and foreign threats. There is no such thing as a call for freedom to defame the Monarchy in Thailand. The present movement in Thailand is solely to call for modernization of the lese majesty law to be more proportional, fair, transparent, and civil. If my fellow citizen has followed the recent developments with open mind and tolerance, this would have been an intuitive call.

I sincerely hope that you will understand that the embarrassing opinion of my fellow citizen does not represent the general sentiment within the country. Likewise, I dare not claim that opinion in this letter is shared by the Thai population as a whole. Therefore, I believe that only the law that permits freedom of expression will allow the full spectrum of thought to be represented equally.

Lastly, I thank you for your declaration, for your friendship and concern in Thailand's deep and fundamental problems. I hope that our nation will one day have the opportunity to reciprocate, because it is in our culture that sincere and constructive criticism is an expression of true friendship
